Go on X (Twitter) and start blasting them. Their social media teams are usually on the ball and they can get other departments to move to avoid anymore bad press.
Are you able to get your ring back at least so you can recoup your diamond?

i work in complaint resolution (eta not for BE), primarily pre-litigation and active litigation.
file an AG complaint. if nothing is fixed from that, hire an attorney and send in a demand letter. if they still refuse, file a small claims case. there is no way you wouldn’t win if you do not have possession of the ring. claim damages in your case for the attorneys fees and filing fees.
most places want to avoid a loss in claims, so they will likely try and settle to avoid litigation. good luck – sorry this is happening to you
I bought a bracelet from them, still haven’t received it. They paid for the cheapest possible shipping apparently and now it’s lost somewhere in the middle of the country. Thought I bought it with enough time to get it and ship it with gifts for Christmas. I don’t even think I will see a resolution of where it’s disappeared to before Christmas. Won’t buy from them again. Is what happens during shipping necessarily their fault? If they pay for the cheapest ever? Yes. Same day I ordered from Shane Co and those items came in with no issues within the week. 🤷♀️ Hell, I ordered a custom bed frame for my son that ships from another country a week ago and that will arrive before I even get a resolution for a freaking in stock, no customization bracelet.
Bottom line- BE sucks. Shane Co stuff came and was GREAT quality. Will probably just order a replacement from them while I have to go through everything with BE.
Did you spend more than $10k? If not, I would suggest you consider small claims. Small claims in my state is up to $10k, and the cases are public, so even big companies don’t like to have them filed. I would strongly suggest you do that, it’s really easy to file.

You hire a lawyer and you Sue! Not only for the losses but for the Fraud, Defamation, and Anguish. If your trail is as solid as you say Any decent lawyer will take it. They will almost certainly try to Settle just do what the lawyer suggests.

Thank you so much for detailing your experience. I was very close to purchasing several items with them, so I will stay well clear now. Make a big stink for sure, post on LinkedIn and reach out to their management on there too. Also reach out to your local newspaper and online newspapers like DailyMail to share your experience. Try to get as much exposure to your experience because as a consumer I need to know this and the level of service is inexcusable. To deny a refund under these circumstances is egregious.

Brilliant earth and any jewelry store in a mall is like buying the most important gift of your life at Walmart.
I’m very puzzled by Amex here actually. You literally have a document that was signed after May, saying BE took the ring in for repair. Is there some weird unclear phrasing in the document? Or is Amex saying that they will not do the chargeback because you must accept the defective ring?

Brilliant earth is absolute trash. Mass produced and poorly made jewelry at inflated prices. Chain jewelers like BE typically base their business model off of upcharging customers that don’t know the value of what they’re buying.

So I am a big fan of luxury brand or mom and pop jewelry for this reason. I get eaten alive for recommending these things but I’ll stand by it until my last breath.
I’m sorry this is happening to you. I worked for BE for a few years and the way they treat their employees is just as despicable as how they treat their customers. I can’t tell you how many times customers came in reasonably frustrated with a situation like yours and the employees had to take the brunt of the frustration because BE isn’t willing to stand by their product or their employees.
At this point. I do think making a stink on social media is the way to go about resolving this. It sucks because as a consumer you shouldn’t have to do this but the ONLY thing BE cares about is its public image. They like to be known as an ethical company, which they’re obviously not. File a complaint with the AG of your state and let them know you’re going to do so. Sometimes that lights a fire under their butt to fix their mistake.
